This Acceptable Use Policy governs the use of all services provided by Kart. By using our services, you agree to comply with this policy at all times.

You may not host, store, distribute, or make available any content that is illegal or unlawful under UK law or the laws of any applicable jurisdiction, including but not limited to:

- Content that infringes copyright, trademark, or other intellectual property rights

- Unlicensed distribution of software, media, or other copyrighted material

- Malware, viruses, trojans, worms, botnets, or similar malicious software

- Content intended to facilitate hacking, unauthorised access, credential harvesting, or exploitation of systems

- Malware, viruses, trojans, worms, botnets, or similar malicious software

- Phishing, scams, fraud, or deceptive practices

- Material that is defamatory, threatening, or unlawfully abusive

Kart does not permit the hosting or transmission of pornographic, sexually explicit, or obscene material. This includes (but is not limited to) explicit images, videos, or text intended for sexual gratification.

The classification of material as “adult”, “explicit”, or “obscene” is determined at Kart’s sole discretion.

You may not use Kart’s services or network to engage in activities that disrupt, damage, or interfere with our infrastructure or the services of others, including but not limited to:

- Sending unsolicited bulk email ("spam") or engaging in email abuse

- Operating open mail relays or misconfigured services that facilitate spam

- Participating in denial-of-service (DoS or DDoS) attacks

- Excessive or abusive scanning, probing, or brute-force activity

- Activities that result in IP blacklisting or reputational harm to Kart or its upstream providers

- Providing VPN services used to hide internet traffic by proxying through our infrastructure

- Scraping content from websites, including but not limited to training AI models

Penetration testing of your own properties hosted on Kart infrastructure is allowed within the scope of your websites only. Running penetration tests against our infrastructure or network is prohibited unless we have given specific permission.

Content or activity that is legal but considered ethically questionable, high-risk, or incompatible with Kart’s business values may be refused or removed at our sole discretion. This includes content that may expose Kart to reputational, operational, or legal risk, even where no law is directly violated.

Kart reserves the right to investigate any suspected breach of this AUP. Where a violation is identified, we may take any action we consider appropriate, including but not limited to:

- Content removal

- Service suspension

- Immediate termination of services

- Refusal of future service

In cases of serious or repeated abuse, termination may occur without prior notice. Clients whose services are terminated for breach of this AUP may be refused future service at Kart’s discretion.

If you believe our services are being used in violation of this Acceptable Use Policy, please report the issue to abuse@kart.dev with sufficient detail to allow us to investigate. We will acknowledge and respond to all complaints within three (3) business days of receipt.

Kart Technologies Ltd (“Kart”, “we”, “us”, “our”) operates a Fair Usage Policy (“FUP”) to ensure the stability, performance, and availability of our services for all customers. This policy is not intended to restrict normal or reasonable use of our services, but to prevent excessive or abusive consumption of shared resources.

For the purposes of this policy, “resources” may include (but are not limited to):

- Network bandwidth and throughput

- CPU and memory utilisation

- Disk I/O and storage performance

-Email sending rates and queue volumes

- Database usage and query load

- Any other shared system or network resources

Most customers will never be affected by this policy. Normal website operation, application hosting, email usage, and development activity are considered reasonable use.

This policy is enforced only where usage is clearly excessive, sustained, or has a material impact on other customers or Kart’s infrastructure.

Usage may be considered excessive or abusive where it:

- Consistently consumes a disproportionate share of shared resources

- Causes service degradation for other customers

- Results in instability, performance issues, or repeated service alerts

-Involves misconfigured applications, runaway processes, or poorly optimised workloads

- Is associated with prohibited activity under the Acceptable Use Policy

Examples include (but are not limited to):

- Uncontrolled background processes or cron jobs

- Abusive scraping, crawling, or API usage

- High volume email sending beyond normal business use

-Resource-intensive workloads running on shared services without prior agreement

- Cryptocurrency mining or similar compute-heavy workloads on shared platforms

- Shared and Email Hosting: These services operate on shared infrastructure and are subject to CPU, memory, disk I/O, and bandwidth fairness controls.

- Dedicated Hosting: Dedicated servers are not subject to CPU or memory usage limits, but may still be subject to bandwidth or network fairness controls.

- Managed Services: Excessive usage caused by client-side misconfiguration or third-party software may still be subject to this policy.

Kart monitors resource usage to ensure platform stability. Where excessive usage is detected, we reserve the right to take reasonable corrective action, which may include:

- Contacting the customer to request corrective action

- Throttling or limiting resource usage

- Temporarily suspending affected services

- Terminating services in cases of repeated or serious abuse

In urgent cases where service stability is at risk, action may be taken immediately and without prior notice.

Unless explicitly stated in a product description or contract, no specific level of resource availability, performance, or throughput is guaranteed on shared services.

Where a customer repeatedly or deliberately disregards this Fair Usage Policy, Kart reserves the right to terminate services and/or refuse future service.

Kart endeavours to apply this policy reasonably and proportionately, and will always prefer communication and resolution over enforcement wherever practicable

These terms apply to all domain name registration, renewal, and management services provided by Kart Technologies Ltd (“Kart”, “we”, “us”, “our”).

By registering or transferring a domain name through Kart, you confirm that you are the lawful registrant (or authorised agent of the registrant) and that all information provided is accurate and kept up to date.

Domain names are typically registered and renewed on an annual basis unless otherwise stated at the time of purchase.

Kart will issue renewal invoices and reminder notifications by email in advance of a domain’s expiry date. All notifications will be sent to the email address associated with your account. It is the registrant’s responsibility to ensure that their contact details, including email address, remain accurate and up to date at all times.

Kart cannot be held responsible for failed renewals resulting from incorrect or outdated contact information.

If you do not wish to renew a domain name, you must notify Kart at least 14 days prior to the domain’s expiry date by contacting support@kart.dev.

If a domain name is not renewed by its expiry date:

- All services associated with the domain (including DNS, hosting, and email) may be suspended.

- The domain may enter a registry-defined grace or protected period, during which renewal may still be possible at the standard renewal fee.

The length and availability of any grace or protected period is determined by the relevant registry and may vary by domain extension. Kart will make reasonable efforts to notify you during this period but cannot guarantee that renewal will remain possible.

If a domain name is not renewed within the applicable grace or protected period, it may be released by the registry and become available for registration by third parties. Kart accepts no liability if a lapsed domain is registered by another party.

Where payment has been received and valid contact details are on file, Kart will make reasonable efforts to renew domain names on behalf of the registrant. However, Kart cannot guarantee the successful renewal of any domain due to factors outside our control, including (but not limited to):

- Registry or registrar system failures

- Registry policy changes

- Late payment or disputed transactions

- Third-party processing delays

Domain registration and renewal services are provided on a best-efforts basis.

Registration of .uk domain names is subject to the terms and conditions of Nominet, the registry for .UK domains.

By registering a .UK domain through Kart, you enter into a separate agreement with Nominet, and you agree to be bound by their policies, including (but not limited to):

- Nominet Terms and Conditions

- Nominet Dispute Resolution Service (DRS) Policy

In the event of any conflict between Kart’s domain terms and Nominet’s policies, Nominet’s policies shall take precedence for .UK domain names.

For .uk domain names, the registrant may request a transfer to another registrar by changing the domain’s IPS tag.

Kart will allow IPS tag changes at any time, provided that:

- The domain name is active and not suspended

- The domain is not subject to a legal dispute, court order, or registry lock

- The request is made by the registrant or an authorised account holder

Kart will not unreasonably withhold or delay a valid transfer request. IPS tag changes will be processed within a reasonable timeframe following receipt of a valid request.

Kart reserves the right to refuse or delay a transfer where required to comply with registry rules, legal obligations, or in cases of suspected fraud or abuse.

This Service Level Agreement ("SLA") applies to eligible hosting services provided by Kart Technologies Ltd, unless otherwise stated in a specific product description or contract.

Kart aims to provide a monthly service availability of 99.9% for applicable hosting services.

"Service Availability" is defined as the percentage of time in a calendar month that Kart’s network and systems are available to provide the relevant service, excluding any permitted downtime as defined below.

The "Kart Network" consists of the infrastructure, equipment, software, and facilities operated or managed by Kart, including Kart’s contracted upstream connectivity, used to deliver hosting services to customers.

Kart is responsible only for service availability within the Kart Network and cannot be held liable for failures or outages originating outside of it.

"Service Downtime" is defined as an unplanned interruption within the Kart Network during which the customer is unable to access the affected service, where the interruption is confirmed by Kart to be caused by an issue within the Kart Network.

Downtime is measured as the total duration of such interruptions in a calendar month.

The following are excluded from Service Downtime calculations:

- Scheduled maintenance or planned service interruptions, where advance notice has been provided via Kart’s service status portal

- Issues outside the Kart Network, including upstream provider outages or internet-wide routing issuess

- Interruptions caused by customer action or configuration, including but not limited to:

- Incorrect server or application configuration

- Non-compliant or unsupported software

- Customer-initiated over-utilisation of resources

- Security incidents, including hacking attempts, denial-of-service attacks, or exploitation of vulnerabilities

- Failures or defects in third-party software not developed or controlled by Kart

Kart provides infrastructure and platform availability only. Any unplanned outages caused by failures or defects in third-party software are the responsibility of the software publisher and are not considered Service Downtime under this SLA.

If service availability falls below 99.9% in a given calendar month, eligible customers may request a service credit.

Service credits are calculated as follows:

- 5% of the monthly service fee for each full 60 minutes of qualifying Service Downtime

- Credits are capped at 100% of the affected service’s monthly fee

Service credits:

- Apply only to hosting service fees

- Do not apply to domain registration, renewal fees, setup fees, or third-party services

- Are issued as account credit or refund at Kart’s discretion

To receive a service credit, the customer must submit a support request within 14 days of the end of the affected calendar month. The request must include sufficient detail to allow Kart to investigate and verify the outage.

Kart’s monitoring and incident records will be used as the authoritative source when determining Service Downtime.

This SLA constitutes the customer’s sole and exclusive remedy for service availability issues. No additional compensation or damages shall be payable in connection with Service Downtime.

Kart endeavours to apply this SLA fairly and transparently, and to resolve service issues promptly and professionally.

This Service Level Agreement ("SLA") applies to eligible hosting services provided by Kart Technologies Ltd, unless otherwise stated in a specific product description or contract.

All services are provided on a prepaid basis, and all fees are payable in UK sterling (GBP) unless otherwise stated.

Payment periods are monthly or annual depending on the product or service purchased. Payment is due in advance of the service period.

Kart reserves the right to amend pricing for any service at any time; however, prices are guaranteed for the duration of the current prepaid period. Any pricing changes will apply only to subsequent renewal periods.

Unless cancelled in advance, services will automatically renew at the end of the prepaid period.

Where services are provided immediately at the customer’s request, the customer acknowledges that their statutory cooling-off rights may be waived once service delivery has commenced.

Invoices and billing notifications are issued electronically and sent to the email address associated with the customer’s account. Paper invoices will not be issued unless specifically requested.

It is the customer’s responsibility to ensure that billing contact details remain accurate and up to date.

Customers may request cancellation of their services at any time.

Where services are cancelled by the customer:

- Prepaid fees are non-refundable, except where required by law

- Services will remain active until the end of the current prepaid period unless otherwise agreed

Kart reserves the right to suspend or terminate services at any time in accordance with these terms.

Where Kart terminates a service without cause, customers will be entitled to a pro rata refund for the unused portion of the prepaid service period.

Where services are suspended or terminated due to a breach of these terms (including the Acceptable Use Policy or Fair Usage Policy), no refund will be issued.- 5% of the monthly service fee for each full 60 minutes of qualifying Service Downtime

Where a service is provided with an initial trial period, this will be clearly indicated at the time of order.

- No refunds are available once a trial period has ended, unless the service is terminated by Kart

- Setup, provisioning, or onboarding fees (where applicable) are non-refundable, even if the service is cancelled

Certain services and fees are non-refundable under all circumstances, including but not limited to:

- Domain name registration, renewal, or transfer fees

- Third-party services or licences

- Setup or provisioning fees

Customers are encouraged to contact Kart to resolve any billing issues before initiating a chargeback or payment dispute.

Kart reserves the right to suspend services and recover any associated costs where a chargeback or reversed payment is initiated without prior contact or valid cause.

Nothing in this policy affects your statutory rights under UK consumer law.

Kart Technologies Ltd is committed to providing a high standard of service. If you wish to make a complaint regarding any aspect of our services, please contact us in writing by emailing support@kart.dev, providing sufficient detail to allow us to investigate the issue.

We will acknowledge and respond to all complaints within three (3) business days of receipt. Where further investigation is required, we will keep you informed of progress and aim to resolve the complaint as promptly and fairly as possible.

If you are dissatisfied with our response to a complaint, you may request that the matter be escalated for further internal review by replying to our response or contacting support@kart.dev with additional information.

For complaints relating specifically to .UK domain names, you may also escalate the matter directly to Nominet, the registry for .UK domains. Nominet operates its own complaints and dispute resolution processes, including the Dispute Resolution Service (DRS), details of which are available at https://nominet.uk/uk-registry/domain-disputes/

For all other matters, if a resolution cannot be reached, disputes may ultimately be subject to the jurisdiction of the courts of England and Wales, in accordance with these terms.

Customers are solely responsible for maintaining their own backups of all data hosted on Kart’s services, including but not limited to website content, databases, emails, and application data.

Kart’s services are not intended to be used as a primary or sole backup solution unless explicitly stated in a separate agreement.

Where a service is suspended or terminated (whether due to non-payment, breach of these terms, or at the customer’s request), access to hosted data may be restricted or removed immediately.

Kart may, at its discretion, retain customer data for a limited period following suspension or termination to allow retrieval.

Where practicable, Kart may retain backups or snapshots of customer data for up to 30 days following suspension or termination. This retention period is not guaranteed and may be shorter depending on:

- The nature of the service

- Operational or storage constraints

- Legal or regulatory requirements

- The circumstances of the suspension or termination

Kart makes no guarantee that any data will be recoverable during or after this period.

Requests for data retrieval following suspension or termination must be made promptly. Kart reserves the right to:

- Refuse retrieval requests where services were terminated due to serious abuse or legal requirements

- Charge reasonable fees for data extraction or recovery

- Require outstanding balances to be settled prior to data release

After the applicable retention period, or where immediate deletion is required, all customer data may be permanently deleted and rendered unrecoverable.

Kart accepts no liability for data loss resulting from suspension, termination, deletion, or customer failure to maintain independent backups.
